Please refer below to the terms and conditions regarding the purchase of Beyond Mind® products (including training programs or courses).  Contact us if you have questions.

Accepting These Terms: By accepting the agreement, you acknowledge you have read and will abide by the Terms and Conditions and agree this purchase is a contract between you and Beyond Mind.

Outline of agreement: Beyond Mind agrees to provide training for the course that you have chosen. In this agreement, reference to ‘Beyond Mind’ includes all instructors who are employed, or act on behalf of Beyond Mind.

Payment: All monies relate to Australian Dollars.

When you register for a course you agree to pay the price stated at the time of booking for the course(s) you have selected.  

• You agree to pay a deposit or you may choose to pay the course in full.
• The deposit must be paid in full and is non-refundable.
• 100% of the course price must be paid before commencing any course and at least 15 days prior to course commencement.

(This is also to ensure your manual and/or books (if applicable), arrive to you on time prior to the course, and also gives you the opportunity to start familiarising yourself with the material.)

Payments not made by the due dates, may result in the cancellation of your place in the course. The deposit is non-refundable.

Transferring To Another Course

If you are unable to attend a course for any reason, you may:

1. Transfer the deposit to a future course (assuming the course is still being run), within 12 months of initial booking. An additional transfer charge of $75 will be applied immediately.
2. Transfer your course to another person (assuming the course is still being run). We require at least 15 days’ notice prior to course start date. An additional transfer charge of $75 will be applied immediately.

Refunds

If you wish to cancel a course after registering for a course, cancellations must be made, in writing, within 3 days of purchase.  Contact us here.   You must ensure we have responded in writing and acknowledged receipt of your communication.

We will refund the money you have paid to us, within 14 business days, less any reasonable costs that have already been incurred by Beyond Mind, such as, but not limited to, books and manuals which have already been issued to you.

After 3 business days, no refund will be available under any circumstances.  You may however transfer to another course or transfer to another person (as in section ‘Transferring To Another Course’).  A transfer free of $75 will be applied immediately.

No refunds will be issued once a course has commenced, however under exceptional circumstances, we may transfer the course amount to a future course. An transfer fee of $75 will apply.

Refunds do not apply to any courses, products or services you received as a bonus or scholarship.

Changes to Courses

When delivering the course, we may change or cancel course days, hours, speakers or locations for any reason by notifying you in writing.  (Whilst this is rare to happen, it is here in case of emergencies). We shall have no liability to you; and you shall make no claim against us (including refunds), in respect of the same.

Cancellation of Courses

Beyond Mind may cancel a Training Program for any reason by written notice to you.  We will then refund you the Investment you have paid us within 14 days of giving you notice of cancellation.  We shall have no further liability to you in respect of cancellation. 

Intellectual Property Rights

You agree that you will not distribute or transmit to another person any training program manuals or online training program access codes. You agree that if you break these commitments, you will be subject to possible prosecution and be removed from all future courses, bonuses, support, community groups and email correspondence without refund.

Results and guarantees

Beyond Mind does not guarantee any results or make any health claims. 

Although the ThetaHealing® Technique has great benefits, results are dependent on a number of factors including, but not limited to your commitment to the course, participation, existing health conditions.

Any testimonials and examples are not intended to represent or guarantee that you will achieve the same or similar results.

Disclaimer

Beyond Mind does not claim to heal, treat or cure any health conditions. The remedies, approaches and techniques described herein are not meant to supplement or be a substitute for professional medical care or treatment.

You should not treat a serious medical ailment without prior consultation from a qualified healthcare professional.  You must continue to take any prescribed medication throughout the entire duration of the course.  Please speak with your doctor about reducing or eliminating meditation if appropriate.

Beyond Mind does not provide medical, legal, investment or business advice.  All opinions are provided for your consideration and should not be solely relied upon. It is your responsibility to obtain professional advice.

Health

In order to experience the full benefits of the ThetaHealing® Technique, please refrain from drinking alcohol or consuming any illegal drugs for at least 48 hours prior to the start of the course/event as this may affect your ability to participate.

It is your responsibility to inform Beyond Mind of any health conditions you have which may impact on your ability to participate on the course.

In order to gain full value from the course, you must be in a reasonable state of health.  If you have a health condition which will impact your ability to participate in the course, Beyond Mind may suggest an alternative method of contact or decline participation for your safety.

Confidentiality

Confidential information refers to any data or information relating to you, whether business or personal: 

• which would reasonably be considered to be private or proprietary to you; 
• that is not generally known, and;
• where the release of that confidential information could reasonably be expected to cause harm to you. 

Beyond Mind agrees that we will not disclose, divulge, reveal, report or use, for any purpose, any confidential information which we have obtained, except as authorised by you or as required by law. The obligations of confidentiality will apply for the duration of the course/event and will survive indefinitely upon termination of this agreement.

All written and oral information and material disclosed or provided by you to Beyond Mind under this agreement is confidential information regardless of whether it was provided before or after the date of this agreement or how it was provided to Beyond Mind.

Any information disclosed to you by other participants as part of the course must also remain confidential.

Business and Self Promotion

Self promotion is not permitted on any platform hosted by Beyond Mind unless permission is obtained directly from us. 

A platform hosted by Beyond Mind includes, but is not limited to, courses, events, practice groups, WhatsApp groups and Facebook groups.

Self promotional material is not permitted on any platform hosted by Beyond Mind and you must not solicit clients on any platform hosted by Beyond Mind.

Should you wish to privately offer sessions to clients, this will be your sole responsibility and your business will be separate from Beyond Mind.

Participation in a course/event is not intended to, or shall not be deemed to establish any partnership or joint venture between you and Beyond Mind.

Beyond Mind is not responsible for providing you with clients.

Reasonable Use of Equipment & Safety

You must take reasonable care at all times during the course to ensure your safety.  Beyond Mind will not be liable for any injury or loss which is caused by your negligence.

Photography and Filming 

You consent to Beyond Mind using photographs and/or video recordings including images of you, both internally and externally to promote our services.

You understand that these images may be used in print and digital media formats, including print publications, website, e-marketing, posters, banners, advertising, film, social media, and teaching purposes.

You have the right to request to see a copy of the information we hold about you and to request corrections or deletions of the information that is no longer required. 

You can ask Beyond Mind to stop using your images at any time, in which case it will not be used in future publications, but may continue to appear in publications already in circulation

Termination of Agreement

Beyond Mind reserves the right to terminate this agreement at any point if we feel that you are being disruptive, are acting in breach of the law, or are in violation of this agreement.  All fees will become payable by you upon termination of this agreement.

Governing Law

This Agreement shall be interpreted, construed and enforced in accordance with Australian law and shall be subject to the exclusive jurisdiction of the Australian Courts.

Limitation of Liability

You agree to limit any claim on Beyond Mind to the cost of the products or services purchased. This includes any loss or damage suffered by you in relation to the performance of the products or services purchased under this agreement.

Entire Agreement

This Agreement is the entire agreement and understanding between Beyond Mind and you and supersedes any prior agreement or understanding whether oral or written relating to this Agreement.
